Rates for the nautical signage service

  1. This rate applies to use of the nautical signage service defined in article 91 of this Act.
  2. The ship or boat owner, the shipping agent and the captain or master of the ship of boat are jointly and severally responsible for payment of this rate.

    At ports, docks and nautical sports facilities that are granted under concession or licence, the concessionaire shall replace the rate payer and shall be bound to meet the material and formal payments of the rate. If the replacement fails to comply with this duty, in particular if the rate is not paid, the Port Authority shall be able to demand payment from the rate payers, notwithstanding the responsibilities held by the replacement.

    At ports, docks and nautical sports facilities that are granted under concession or licence, the concessionaire shall pass on the charge to the ship's owner. This shall be done using an invoice or similar document that includes the expression "Charge for the nautical signage service included in the price at a rate of...".

    Charges arising from payments relating to inspections shall not be passed on.
  3. The rate shall be paid when the ship or boat begins to receive the services in waters under Spanish jurisdiction outside the port's service area.
  4. This rate is based on the following quantitative amounts: the ship's Gross Tonnage, the boat's size or unit and the activity undertaken.
  5. The rate is as follows:
    1. For merchant ships, as well as deep-freezing fishing boats and generally those ships that pay the ship rate because of their characteristics: 0.8323 euros for each100 Gross Tonnes for the first three stopovers of each calendar year.
    2. For ships and boats used for sea fishing or deep sea fishing: 0.2601 euros per Gross Tonne unit and per calendar year.
    3. For ships and boats used for in-shore or coastal fishing: 12.7969 euros per ship or boat and per calendar year.
    4. For leisure and sports boats whose length measures or exceeds seven metres and which should have a "Licencia de navegación" or "Rol de despacho o dotación de buques" (Spanish registration documents): 4.1616 euros per square metre, which is the calculation of the ship's maximum length divided by its maximum beam and per calendar year.
    5. For leisure and sports boats whose length measures less than seven metres and which should have a "Licencia de navegación" or "Rol de despacho o dotación de buques" (Spanish registration documents): 10.404 euros per square metre, which is the calculation of the ship's maximum length divided by its maximum beam.
  6. Payment of the rate may be demanded from:
    1. The ships and boats included in paragraph a) of the previous section: for the first three stopovers in a calendar year and at each port they enter.
    2. The ships and boats included in paragraphs b), c) and d) of the previous section: the amount should be paid once a year to the Port Authority assigned for nautical signage purposes within the geographical area in which the ship's base port is located.

      In the event that ships do not have a base on the Spanish coast, 20% of the rate shall be paid at the first port in which they stopover in the calendar year and this shall be valid for a period of ten days. This amount shall be payable once again for identical periods of time until a maximum 100% of the rate has been paid in a calendar year.
    3. The boats referred to in paragraph e) of the previous section: the rate shall be paid once, when the boat is registered. The rate shall be paid to the Port Authority assigned for nautical signage purposes within the geographical area in which the relevant body is located that registers the boat.
  7. The relevant body that registers the boat, "rol de despacho o dotación" and who issues the inspection certificates relating to the aforementioned requirements, shall need proof that the nautical signage service rate has been paid.

    The Port Authorities shall require proof that the rate has been paid to be shown and if this is not possible, payment must be made.

    The autonomous regions in Spain, the port organisations dependent on or linked to the autonomous regions and the concessionaires or licensees of ports, docks and port installations should provide the relevant Port Authority with any required information and should provide the information needed for payment of this rate.
  8. The Port Authorities and, where applicable, the State Ports should sign agreements with the autonomous regions in Spain and port organisations dependent on or linked to the autonomous regions for the payment of this rate.
  9. The rate may be demanded on a simplified estimate basis at ports, docks or nautical sports facilities that are granted under concession or licence, except where the concessionaire or licensee expressly rejects this. This rate shall be set out for each concession or licence taking into account statistical traffic data on the concession or licence in the last few years and an overall payment for the amount relating to estimated occupation shall be made periodically.

    Those who opt for this system shall receive a 20% discount on the rate.
